Welcome to Nutricious4u! These Terms and Conditions govern your use of the Nutricious4u mobile application (the "App") and related services. By creating an account, accessing, or using the App, you agree to be bound by these Terms. Please read them carefully.
By downloading, installing, accessing, or using the Nutricious4u App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy, which explains how we collect and use your data. If you do not agree to these Terms, you must not use the App.
These Terms constitute a legally binding agreement between you and Nutricious4u. Your continued use of the App following any changes to these Terms constitutes acceptance of those changes.
You must be at least 18 years of age to use the Nutricious4u App. By using the App, you represent and warrant that:

Nutricious4u uses Firebase Authentication to secure your account. However, you acknowledge that no system is completely secure, and we cannot guarantee absolute security.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current. Providing false or misleading information may result in account termination.

By default, all subscriptions automatically renew. Your subscription will automatically renew at the end of each subscription period unless you disable auto-renewal or cancel your subscription before the renewal date.
You can manage auto-renewal settings in your account preferences at any time. If auto-renewal is enabled, your subscription access will renew automatically unless you disable it. Payment terms (if applicable) are handled separately.
You will receive payment reminder notifications:
You may queue a new subscription plan while your current plan is active. The queued plan will automatically activate when your current subscription expires.
You may cancel your subscription at any time through your account settings. Upon cancellation:

New users who have never subscribed to a paid plan are eligible for a one-time 3-day free trial of Nutricious4u premium features.
During the free trial, you will have access to all premium features, including:
When your 3-day trial expires, you MUST subscribe to a paid plan to continue using the App. There is no permanent free plan available. If you do not subscribe to a paid plan:

You acknowledge that AI-generated content may contain errors or inaccuracies and should not be solely relied upon for health decisions.
Subscribers receive access to professional dietician services, including:
Dietician services and availability may vary by plan and scheduling constraints.
We strive to provide continuous access to the App, but we do not guarantee uninterrupted service. The App may be temporarily unavailable due to:
We reserve the right to modify, suspend, or discontinue any feature or service at any time with or without notice.
THE NUTRICIOUS4U APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
The information, content, and services provided by Nutricious4u, including but not limited to nutrition recommendations, diet plans, calorie calculations, AI-generated advice, and dietician consultations, are for informational and educational purposes only.
You acknowledge and agree that:
Dietician services provided through the App do not replace comprehensive medical care. Our dieticians provide nutritional guidance but are not responsible for diagnosing or treating medical conditions.
By using the App, you assume full responsibility for your health decisions and any consequences that may result from following the App's recommendations.
The App uses Google Gemini AI technology to provide nutrition analysis and personalized recommendations. You acknowledge and agree that:
When using AI features, your data is processed by Google's Gemini AI service. This includes:

We do not warrant that AI-generated content will be accurate, complete, reliable, or suitable for your purposes. You use AI features at your own risk.

The App, including all content, features, functionality, software, user interfaces, graphics, designs, and compilation of user data, is owned by Nutricious4u and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You may not:
You retain ownership of the content you create and upload to the App, including:
By using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process your content solely for the purpose of providing and improving the App's services.
Diet plans and PDFs created by dieticians remain the intellectual property of Nutricious4u and the creating dietician. You are granted a personal, non-transferable license to use these materials for your own health and nutrition purposes only. You may not:

Dietician accounts cannot be deleted through the standard account deletion process. Dieticians must contact us directly to close their accounts.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
IN NO EVENT SHALL NUTRICIOUS4U, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, DIETICIANS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
This limitation applies regardless of whether we were advised of the possibility of such damages.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN SUBSCRIPTION FEES DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ₹5,000, WHICHEVER IS LESS.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WE MAKE NO GUARANTEES REGARDING HEALTH OUTCOMES, WEIGHT LOSS, FITNESS IMPROVEMENTS, OR ANY OTHER HEALTH-RELATED RESULTS FROM USING THE APP. Individual results vary based on numerous factors beyond our control.
You agree to defend, indemnify, and hold harmless Nutricious4u, its officers, directors, employees, agents, dieticians, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
Before filing any formal dispute, you agree to first contact us at nutricious4u@gmail.com to attempt to resolve the issue informally. We will work with you in good faith to resolve complaints.
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996.
You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.
Either party may seek injunctive or other equitable relief in court to protect intellectual property rights or confidential information.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Subject to the arbitration provisions above, you agree that any legal action or proceeding shall be brought exclusively in the courts located in Delhi, India, and you consent to the personal jurisdiction of such courts.
If you access the App from outside India, you are responsible for compliance with local laws and regulations. By using the App, you consent to the transfer of your data to India and processing in accordance with Indian law.
We reserve the right to modify these Terms at any time. When we make material changes, we will:
Your continued use of the App after changes to these Terms constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and may delete your account.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nutricious4u regarding the use of the App and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.
You may not assign or transfer these Terms or your account to any third party without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
These Terms are provided in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.
